Rental Rules & Conditions

  • Rentals of 5 days or longer include unlimited mileage (shorter rentals get a daily allowance: 300 km on day 1, up to 600 km by day 4).
  • Driving is allowed within mainland Spain only, with Ibiza as the sole exception.
  • Returning the car early does not entitle you to a refund for the unused days.

1. What this agreement covers

Island Cars provides the vehicle in working order for the renter's temporary use; the renter agrees to pay the rental fee and return the vehicle, in working order, at the date, time and place stated in the booking.

The equipment supplied with the vehicle is listed on the handover sheet and forms part of this agreement.

Renters who decline the optional Full Cover insurance must leave a refundable deposit of €1,200.

Drivers must be at least 21 years old; exceptions may be granted at Island Cars' discretion.

The rental price includes: unlimited mileage on rentals of 5+ days (or the daily allowance above on shorter rentals), road tax, 21% IVA, mandatory third-party liability insurance, roadside towing after an accident, a replacement vehicle if the car breaks down through no fault of the renter, a second-driver option, and full insurance coverage.

2. Rights and obligations

The vehicle is handed over in good working condition with a full tank; depending on the fuel option chosen, it must be returned either full or empty — unused fuel left in the tank is not refunded.

Renters may not modify the vehicle or add or remove accessories without prior authorization.

At the end of the rental, the vehicle must be returned with all its equipment, allowing for normal wear, at the agreed place and time.

Returns more than one hour late are charged at double the daily rate for each late day.

The renter is responsible for:

  • Paying any fines received during the rental. Fines notified after the rental ends carry an additional €40 processing fee; unpaid fines may be reported to the police.
  • A deep-cleaning fee of up to €100 if the interior needs it on return.
  • €150 to replace a lost electronic key (€50 for a key without electronic locking), plus delivery costs where applicable.
  • Returning the vehicle to Island Cars' lot or another agreed location.
  • Parking fees (including any after the rental period if the car isn't returned properly), tolls, and other running costs, except maintenance costs or costs caused by Island Cars.

In the event of damage or an accident, the renter must:

  • Report it immediately to the police or relevant authority, and to Island Cars.
  • Collect witness details and photograph the scene.
  • If at fault and without Full Cover, cover the repair cost and the vehicle's downtime at the official dealer's rate.

Island Cars will:

  • Refund the deposit within 5 business days, provided all contract terms were met.
  • Hand over and collect the vehicle at the agreed time and place.
  • Repair or replace the vehicle promptly if it breaks down through no fault of the renter.

3. Unauthorized use

While driving, the renter must take reasonable care, follow traffic regulations, and avoid anything that could damage the vehicle or harm others; the renter is fully liable for damage from unauthorized use, including by unauthorized drivers.

Unauthorized use includes, without limitation:

  • Towing another vehicle or trailer.
  • Driving on beaches, race tracks, forest trails, or other terrain unsuited to road vehicles.
  • Driving on unpaved roads, or paved roads in poor condition likely to damage the underbody.
  • Entering restricted areas, including airport aprons or military/aviation zones.
  • Ignoring dashboard warning lights — by signing this agreement you confirm you understand what they mean.
  • Transporting animals or hazardous, flammable, or otherwise harmful substances.
  • Using the vehicle as a taxi, transfer, or other paid transport service.
  • Subletting the vehicle.
  • Any unlawful activity.
  • Carrying more passengers or cargo than the manufacturer's specifications allow.
  • Tampering with or interfering with the odometer — report any malfunction immediately.
  • Carrying luggage or items on the roof, even with a proper rack.
  • Leaving valuables visible inside the car where they could attract theft.
  • Leaving the interior significantly dirtier than normal use would cause.
  • Using the vehicle for driving lessons of any kind.
  • Driving in violation of traffic law.
  • Letting anyone drive who isn't authorized under this contract or lacks the required documents.
  • Using the vehicle after the rental period has ended.

Smoking in the vehicle carries a €200 fine.

Driving outside mainland Spain, Ibiza excepted, carries a €200 fine.

4. Term and termination

This agreement takes effect once signed by both parties.

Returning the vehicle early does not entitle the renter to a refund for unused days.

If the renter breaches any term of this agreement, Island Cars may terminate it immediately, without prior notice, and repossess the vehicle regardless of its location. Island Cars is not liable for belongings left in the vehicle at the time of repossession, though it will make reasonable efforts to safeguard them. Rental fees already paid for unused days are non-refundable in this case, and the renter must cover any costs Island Cars incurs recovering the vehicle.

5. Other terms

Any changes to this agreement, or terms not covered here, must be recorded in a signed written addendum.

This agreement is drawn up in Spanish (English, Russian, and German versions are provided only to help renters understand it) and signed in two copies, one per party, under the laws of the Kingdom of Spain.

Disputes will first be addressed directly between the parties; if unresolved, they will be settled under Spanish law before the courts of Spain.

6. Data processing

By signing, you agree that your personal data may be shared with national and regional authorities, insurers, and public or private bodies in connection with traffic violations or unpaid tolls, as well as with Spanish and EU courts and law-enforcement bodies. Your data may also be processed to assess customer satisfaction. You may exercise your rights to access, correct, delete, or restrict the use of your data at any time.
